Terms and Conditions for Trusted Parents

Reference to ‘we’, ‘us’, ‘our’ or ‘Trusted Parents’ refers to both Trusted Parents Ltd and/or Best of Parenting Ltd and includes both our website and app facilities.

Your accessing or use of www.trustedparents.com (‘site’) and all associated products and services we offer under these Terms acts as confirmation of your acceptance of the below Terms and Conditions, and you thereby become a ‘user’ as referred to in these Terms. We advise that you read the below Terms carefully and in full before proceeding to use Trusted Parents.

  • Eligibility of Use
    • Trusted Parents is for use by parents/guardians and adults who accept these Terms.
    • You agree to provide Trusted Parents only with accurate, current and complete information.
    • Providing false information to us is prohibited by these Terms, and may also be a criminal offence. We will report any criminal activity or suspicious activity to the relevant authorities.
    • Registered sex offenders and their households are not eligible to use Trusted Parents.
    • We reserve the right to refuse use to anyone we deem a risk to other Trusted Parents users at our absolute discretion.
    • Please be aware that we do not carry out background or DBS checks against website users. Individuals must therefore exercise caution and satisfy themselves that any individual they make contact with is appropriate. We will not accept any responsibility for ensuring the suitability of individuals. Trusted Parents is not responsible for ensuring users provide accurate, current and complete information.
    • The fact that an individual makes use of our site does not constitute our recommending that the individual is a suitable user, and it is entirely your responsibility to ensure each individual you connect with is appropriate and not a risk to you or any other third party
    • Where you suspect an individual may not be a suitable user of Trusted Parents, or that a user is not complying with these Terms and Conditions, you must contact us immediately and we will take appropriate action.
    • Where we decide to terminate a user’s access to Trusted Parents, or where we receive information concerning a user’s suitability, we are not obliged to disclose such information to existing or new users, except where deemed appropriate at our absolute discretion, or if we are otherwise required to do so by law.
  • Safety
    • Trusted Parents helps to enable users to contact other users to broadcast information, to share transport for various events such as school or birthday parties or share childcare or other similar arrangements as described on our site. However, it is not our responsibility to arrange and/or advise you regarding such arrangements, and should you chose to utilise our messaging software to make contact with third parties and other users, the decision as to how you make contact, with whom, when, and on what basis, and all consequences flowing therefrom is your responsibility alone.
    • We have no obligation to ascertain or verify the identity of users and therefore give no warranty as to the identity of users, nor do we moderate content published by users- which is the sole responsibility of users.
    • We are not liable where users provide false information regarding their suitability - including regarding driving licences, vehicles or qualifications.
    • You are therefore advised to satisfy yourself that the user you connect with is suitable, including the validity of such licences or qualifications as may be relevant.
    • You are also advised to take all necessary precautions when arranging to meet another user. We are not liable for any consequences arising out of meetings between users, whether onsite or in person as a consequence of the use of Trusted Parents. The decision to meet another user is yours alone.
    • It is recommended that you inform someone of your intention to meet another user in person, and that you arrange to meet them in a busy public place initially, for your own safety.
  • Acceptable Usage Policy
    • You must use Trusted Parents in a manner that is lawful, ensuring full compliance with any and all local, national or international laws and/or regulations.
    • You must not use Trusted Parents for any unlawful or fraudulent purposes.
    • You must not use Trusted Parents to knowingly send, upload or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software or any other data.
    • You must not use Trusted Parents as a means of harming any person or persons in any way.
    • We reserve the right to suspend or terminate your access to Trusted Parents if you materially breach the provision of these Terms, and may also take legal proceedings against you for reimbursement of any and all relevant costs, losses and expenses suffered or incurred by us on an indemnity basis resulting from your breach.
    • Where necessary, we may take further legal action against you as appropriate, and disclose such information to law enforcement authorities as required or as we deem reasonably necessary.
    • Trusted Parents allows you to post content, including photos, comments, text, calendar and activity icons, links and other materials. Anything that users post, create or otherwise make available on Trusted Parents is referred to as “User Generated Content”.
    • You are solely responsible for the User Generated Content generated from you and/or your account.
    • You must not provide us with any User Generated Content which you do not have the right to publish, or that is prohibited by these Terms and Conditions.
  • Password/ Security
    • You should not disclose any password or account details to any other person. Where Trusted Parents becomes aware that a user has disclosed such information, we reserve the right to terminate that individual’s use and/or account at our absolute discretion.
    • You should ensure that your account is accessed only by you, and should not transfer or share your account with any other person.
    • We are not liable for the consequences of any user utilising another user’s identity. However, if you suspect another user may be using your identity, please inform us immediately and we will take appropriate action.
    • Should your password become lost or compromised, we will take appropriate action including the suspension of your account where necessary upon notification or our discovery of the same.
  • Computer Misuse
    • You are responsible for protecting your hardware, software, data and other material from viruses, malware and other internet security risks.
    • You must not knowingly introduce viruses, Trojans or other malware or technologically harmful material or any other material which is malicious either to or via our site.
    • You must not attempt to gain unauthorised access to any part of our site, the server on which our site is stored, or any other server, computer or database connected to our site.
    • You must not attack our site by means of a denial of service attack, a distributed denial of service attack, or by other means.
    • Breach of clauses 5.2 to 5.4 may constitute a criminal offence under the Computer Misuse Act 1990. Any and all such breaches will be reported to the relevant law enforcement authorities and we will cooperate fully with those authorities, including disclosing your identity to them.
    • Your right to use our site will cease immediately in the event of a breach of clauses 5.2 to 5.4.
    • Please note, whilst Trusted Parents has security measures in place to ensure that our site is free from viruses and other malware, we accept no liability for any loss or damage resulting from a virus or other malware, a distributed denial of service attack, or other harmful material or event that may adversely affect your hardware, software, data or other material that occurs as a result of your use of our site (including the downloading of any content from it) or any other site referred to on our site.
  • House Rules
    • You are required to treat other users with respect. Trusted Parents will not tolerate the following behaviour:
      • personal attacks or the use of offensive language;
      • hatred on the basis of race, ethnicity, religion, sexuality, gender, nationality, disability or other personal characteristic;
      • illegal activity, or actions prohibited by law.
    • You may only use our site in a manner that is lawful and:
      • ensure that you comply fully with any and all local, national or international laws and/or regulations;
      • you must not use our site in any way, or for any purpose, that is unlawful or fraudulent;
      • you must not use our site in any way, or for any purpose, that is intended to harm any person or persons in any way.
    • Any behaviour deemed by us in our discretion to be inappropriate may result in users being suspended or prohibited from using Trusted Parents.
    • You are reminded that Trusted Parents accepts no responsibility for User Generated Content. Your use of Trusted Parents acts as your confirmation that you accept you may be exposed to content which may be deemed to be offensive or inappropriate. If you are so exposed, you must report your concerns to us by email at contact@trustedparents.com.
  • Intellectual Property Rights
    • All content created by us and included on our site or app and the copyright and other intellectual property rights subsisting in that content, unless specifically labelled otherwise, belongs to or has been licensed by us. All content is protected by applicable United Kingdom and international intellectual property laws and treaties.
    • You may not reproduce, copy, distribute, sell, rent, sub-licence, store or in any other manner re-use content from Trusted Parents unless we provide express written permission to do so.
    • You are entitled to access, view and use Trusted Parents, including downloading from our site and saving pages for later viewing.
    • Our status as the owner and author of our created content on our site must always be acknowledged.
    • You may not use content saved or downloaded from our site for commercial purposes unless we provide express written permission.
    • Your use of Trusted Parents grants us and our users a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, share, modify, create derivative works, perform and distribute your User Generated Content on Trusted Parents solely for the purpose of operating, developing, providing and using the products.
    • Nothing in these terms will restrict other legal rights we may have to User Generated Content, including User Generated Content that we believe violates these Terms and/or our policies.
    • Following termination or deactivation of your Trusted Parents account, or your removal of User Generated Content from your account, we may retain your User Generated Content for a reasonable period of time for archival, audit or back-up purposes. Other Trusted Parents users may also retain and continue to use, store, display, reproduce, share, modify, create derivative works, perform and distribute any of your User Generated Content that other users have stored or shared through Trusted Parents.
  • Privacy and Cookies
    • Use of Trusted Parents is also governed by our Privacy Policy which details information about how your data is used, and also provides information regarding our use of cookies. This Privacy Policy is incorporated into these Terms and Conditions by this reference.
  • Changes/Access to Trusted Parents
    • We reserve the right to alter these Terms and Conditions at any time. Amendments will be made to this page. Any such changes will become binding on you upon your first use of our site after the changes have been implemented. You are therefore advised to check this page regularly to ensure you are aware of any such changes.
    • Whilst we make reasonable efforts to ensure that content on our site is complete, accurate and up-to-date, we do not make any representations, warranties or guarantees (whether express or implied) that the content is complete, accurate or up-to-date.
    • Access to our website or other services is provided “as is” and on an “as available” basis. We may alter, suspend or discontinue our website or other services (or any part of them) at any time and without prior notice to you. We will not be liable to you in any way if any of our services are unavailable at any time and for any period.
    • We neither assume nor accept responsibility or liability arising out of any disruption or non-availability of our site resulting from external causes including, but not limited to, equipment failure, natural events or legal restrictions and censorship.
  • Link to Third Parties/ Other Sites
    • Trusted Parents may recommend links to other sites, or other third parties. Please note, such third parties are not under the control of Trusted Parents.
    • Trusted Parents has no control over the contents of third parties’ websites and does not assume or accept responsibility or liability for such content and is not responsible for any loss or damage caused by your use of them.
    • The inclusion of a link to third parties or their sites is for your information only and does not imply any endorsement of the sites themselves or of those in control of them.
    • Where Trusted Parents advertises service providers, including but not limited to nannies, extra-curricular activity providers and babysitters, such service providers have not been assessed by Trusted Parents and it is your responsibility to assess their suitability. Your use of their services and your decision to do so is entirely at your own risk. We are not an employment agency and make no introduction to potential service providers or employees.
    • Where Trusted Parents advertises websites that offer a comparison of service providers. Trusted Parents accepts no responsibility for the accuracy of such content. It is your responsibility to assess the service provider and whether you use them.
    • Please note, such third party service providers will also utilise their own Terms and Privacy Policy, which may differ to Trusted Parents’ policies. Therefore, we recommend you familiarise yourself with such policies before use of third party sites or services.
  • Our Liability
    • Our site does not aim to instruct, guide or otherwise influence you in relation to decisions you make following the use of our site. The following clauses operate as reasonable and fully enforceable exclusions and/or limitations of our liability to you.
    • Where you use Trusted Parents to arrange the sharing of different services - including but not limited to travel and use of child minders, Trusted Parents is not liable for the consequences of your decision in relation to such events.
    • To the fullest extent permissible by law, we accept no liability to any user for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) our site or the use of or reliance upon any content included on our site.
    • To the fullest extent permissible by law, we exclude all representations, warranties and guarantees (whether express or implied) that may apply to our site or any content created by us and included on our site.
    • If you are a business user, we accept no liability for loss of profits, sales, business or revenue, loss of business opportunity, goodwill or reputation, loss of anticipated savings, business interruption or for any indirect or consequential loss or damage.
    • Nothing in these Terms and Conditions excludes or restricts our liability for fraud or fraudulent misrepresentation, for death or personal injury resulting from negligence, or for any other forms of liability which cannot be excluded or restricted by law. For full details of consumers’ legal rights, including those relating to digital content, please contact your local Citizen’s Advice Bureau or Trading Standards Office.
    • Whilst our site or apps may include advertisements, we are in no way liable for the content, suitability or accuracy of such advertisements nor third party services. We do not endorse third party advertisements, nor do we seek to induce you to utilise third party services. Should you rely on or be encouraged by any such advertisement, you do so at entirely your own risk.
    • Please note, whilst we may receive payment and/or commission from third parties for advertisements, or where we offer a discount code for third parties, we are in no way liable for the actions of, nor have control over, such third parties. We do not seek to endorse third parties and where you engage with third parties you do so at entirely your own risk. We accept no liability for any consequential loss, damage, contractual breach or otherwise resulting from your decision to engage with such third parties.
  • Purchased Goods, Facilities and Services
    • If you order goods and/or facilities or services from anyone other than Trusted Parents whether through any commercial website and/or services accessible through Trusted Parents’ website or app, all transaction terms including, but not limited to, purchase terms, payment terms, warranties, guarantees, maintenance and delivery are solely between you and the seller of the goods and/or facilities and/or services.
    • You are solely responsible for fulfilling any contractual, e-commerce or other obligations which you assume through any transaction listed in clause 12.1. We provide no warranties or representations with regard to any goods, facilities or services provided and shall not be liable for any costs and/or damages arising (directly or indirectly) from the goods, facilities and/or services ordered and/or from any actions or inactions of the seller of any items.
  • Jurisdiction and Governing Law
    • These Terms and Conditions are governed by and will be interpreted in accordance with the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction in respect of any claim or dispute which may arise in connection with these Terms and Conditions or in connection with and/or arising from any of Trusted Parents’ site, app or other services or products.
